By accessing or using MusicMageX ("the Service"), operated by MusicMageX ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and MusicMageX.
MusicMageX is an AI-powered music generation platform that creates original audio content based on user-provided text descriptions, lyrics, musical parameters, and creative direction. The Service uses diffusion-based machine learning models that generate audio from mathematical noise patterns. The Service does not sample, copy, interpolate, or reproduce existing copyrighted sound recordings or musical compositions. No user-uploaded audio is accepted or processed by the Service.
The Service includes post-processing features such as a mastering pipeline and digital provenance watermarking, which are applied to all generated content as described in these Terms.
You must be at least 13 years of age to use the Service, or 16 years of age if you reside in the European Union, European Economic Area, or the United Kingdom, in accordance with the General Data Protection Regulation (GDPR). By creating an account, you represent and warrant that you meet the applicable minimum age requirement for your jurisdiction. If you are between the minimum age and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account credentials or allow others to access your account. You must provide accurate, current, and complete information when creating your account, and update such information as necessary. MusicMageX reserves the right to suspend or terminate accounts with false or misleading information.
Audio content generated through the Service is created through a combination of your creative direction (text prompts, lyrics, instrument selections, musical parameters) and AI processing. MusicMageX does not claim ownership of the audio content you generate. Your usage rights to generated content depend on your subscription tier as described below.
Users on the Free tier are granted a perpetual, worldwide, non-exclusive license to use their generated audio for personal, non-commercial purposes including:
Free tier users may not use generated content for commercial purposes including but not limited to: selling or licensing music, monetized YouTube/TikTok/social media content, commercial podcasts, games, advertisements, streaming distribution (Spotify, Apple Music, etc.), sync licensing, or any use where direct or indirect revenue is generated from the content. To unlock commercial rights, upgrade to any paid plan.
Violation of this restriction may result in account suspension and revocation of the personal use license for affected content.
Users on any active paid subscription tier are granted a perpetual, worldwide, royalty-free, non-exclusive license to use, modify, distribute, perform, sublicense, and commercially exploit audio generated through the Service, including but not limited to:
MusicMageX will never demand royalties, revenue shares, or licensing fees for content you create on our platform. Your commercial rights persist even if you later downgrade or cancel your subscription — songs created during an active paid subscription retain their commercial license permanently.
Non-exclusive license: Because the AI model may generate similar output for different users with similar inputs, your license is non-exclusive. MusicMageX does not guarantee that substantially similar audio cannot be independently generated by another user. You do not receive exclusive rights to any style, genre, sound, or musical pattern.
Songs generated using purchased credits inherit the commercial rights of your current subscription tier at the time of generation. If you are on the Free tier and use purchased credits, the generated content is subject to the personal use license (Section 4.1). If you are on a paid tier and use credits, the generated content receives the full commercial license (Section 4.2).
By using the Service, you grant MusicMageX a limited, non-exclusive, royalty-free, irrevocable license to use generated content solely for the following purposes:
This platform license does not grant MusicMageX the right to sell, sublicense to third parties for their commercial use, or commercially exploit your content in competition with your own use. This license survives account deletion to the extent necessary for content already incorporated into platform features or promotional materials, but we will honor opt-out requests within 30 days.
The legal status of copyright protection for AI-generated and AI-assisted works varies by jurisdiction and is actively evolving. As of the effective date of these Terms, multiple jurisdictions (including the United States) have taken the position that purely AI-generated works may not qualify for copyright protection. MusicMageX makes no representations or guarantees that generated content qualifies for copyright registration, copyright protection, or any form of intellectual property protection in any jurisdiction. You are solely responsible for determining the legal status and protectability of your generated content in your jurisdiction and for seeking independent legal advice if needed.
You are solely responsible for all content you generate and how you use it. AI-generated music may unintentionally resemble existing copyrighted works due to patterns learned during model training. MusicMageX does not guarantee that generated content is free from similarity to third-party works and does not provide legal clearance for any generated content. You agree to indemnify MusicMageX against any claims, damages, or expenses arising from your use, distribution, or commercial exploitation of generated content.
All audio files generated through the Service include an inaudible digital provenance watermark embedded in ultrasonic frequencies. By using the Service, you acknowledge, understand, and agree to the following:
Additionally, each audio file includes standard metadata tags (title, artist name, generation parameters) that are visible in music players. Metadata tags can be edited or removed by the user; the ultrasonic watermark cannot be removed without degrading audio quality.
Each subscription tier includes a storage allocation equal to its monthly song limit (e.g., Free: 10 songs, Starter: 50 songs, Pro: 150 songs, Advantage: 300 songs). When your stored audio files exceed this limit, the oldest audio files are automatically archived — the audio file is removed from our servers, but all generation metadata (seed, prompt, lyrics, BPM, key, instruments, mastering settings) is preserved indefinitely.
Archived songs can be regenerated at any time using the preserved metadata. While regenerated songs use identical parameters and seeds, minor variations may occur due to model updates. We recommend downloading and backing up any songs you wish to keep permanently.
Patron and administrative accounts receive permanent audio storage and are exempt from automatic archiving.
Account deletion: If you delete your account, all associated audio files will be permanently deleted within 30 days. Generation metadata may be retained in anonymized form for service improvement purposes as described in Section 4.4.

The Service offers free and paid subscription tiers with varying feature access, monthly usage limits, maximum audio duration, and output format options. Features and limits for each tier are described on the Service and may be updated from time to time with reasonable notice.
Paid subscriptions are billed on a recurring monthly basis starting from the date of purchase. You may cancel your subscription at any time through your account settings or by contacting support.
Upon cancellation of a paid subscription:
Song credits may be purchased separately and do not expire. Credit pricing is displayed on the Service at the time of purchase. Prices may change for future purchases but will not affect credits already purchased. Credit purchases are non-refundable once credits have been used. Unused credits may be refunded within 14 days of purchase upon request.
Cancelled generations (where the user initiates cancellation after submission) count toward the monthly generation limit, as server resources are consumed upon submission.
MusicMageX uses artificial intelligence to generate music. AI music generation is an emerging technology with inherent limitations. By using the Service, you acknowledge and agree that:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTIES REGARDING THE QUALITY, ACCURACY, ORIGINALITY, LEGALITY, OR COMMERCIAL VIABILITY OF ANY GENERATED CONTENT. WE DO NOT WARRANT THAT GENERATED CONTENT IS FREE FROM SIMILARITY TO EXISTING COPYRIGHTED WORKS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSICMAGEX AND ITS OPERATORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFITS, DATA, OR BUSINESS OPPORTUNITIES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless MusicMageX, its operators, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your generated content and any distribution or commercial exploitation thereof; (c) your violation of these Terms; (d) your violation of any rights of a third party; or (e) any claim that your generated content infringes or misappropriates the intellectual property rights of any third party.
MusicMageX respects the intellectual property rights of others. If you believe that content available through the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information to our designated agent:

Upon receipt of a valid DMCA notice, we will investigate and take appropriate action, which may include removing or disabling access to the allegedly infringing content and notifying the affected user. Repeat infringers may have their accounts terminated.
We reserve the right to remove content, suspend or terminate accounts, and refuse service to anyone who violates these Terms or whom we reasonably believe to be engaging in harmful, infringing, or abusive conduct. We may also suspend or terminate the Service at any time with reasonable notice. Upon termination, your right to use the Service ceases immediately, but the licenses granted under Sections 4.1 and 4.2 for content already generated shall survive termination.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation by contacting us at support@musicmagex.com. If informal resolution is unsuccessful within thirty (30) days, the dispute shall be submitted to the competent courts of the jurisdiction where the Service operator is established. For users residing in the European Union, nothing in this section limits your right to bring proceedings before the courts of your country of residence as provided by applicable law. Each party shall bear its own costs unless otherwise ordered by the court. To the extent permitted by applicable law, disputes shall be resolved on an individual basis; class actions and collective proceedings are not permitted.
We may modify these Terms at any time by posting updated Terms on the Service. Material changes will be communicated via email to the address associated with your account or through a prominent notice on the Service at least fourteen (14) days before they take effect. Your continued use of the Service after the effective date of any modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is established, without regard to its conflict of law provisions. If you are a consumer residing in the European Union, you will also benefit from any mandatory provisions of the law of the country in which you reside.
If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. The failure of MusicMageX to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MusicMageX regarding the Service, and supersede all prior agreements, understandings, representations, and negotiations, whether written or oral.
